Malcolm Smith is a civil trial lawyer with 20+ years of experienceHe articled in Vancouver in the 1990s and then practiced throughout the province over the next few years gaining valuable court room experience in diverse matters as a young trial lawyer, including appearing as ad-hoc provincial Crown in family and criminal matters, and as trial counsel in complicated commercial and construction litigation suits.
Since 2000 he has been practicing in Victoria, and specializes in acting for clients injured in Motor Vehicle Accidents.
He regularly prosecutes complicated MVA claims of individuals suffering from catastrophic injuries, brain injuries, chronic pain, and musculoskeletal damage. He has acted for members of the Canadian Forces and the RCMP facing medical release and discharge as a result of their MVA injuries, and so is well versed in the unique procedures there. He has acted for small business owners, contractors, and professionals whose income loss claims are complicated.
Malcolm is an effective negotiator outside of the courtroom, and a tenacious advocate once in trial. He regularly negotiates the final resolution of matters outside of the courtroom with or without mediation. If need be, he is a persuasive advocate in Court with a long list of victories.
